While French Detours makes every effort to ensure that the information contained on our website is accurate, French Detours takes no responsibility for incorrect, outdated, or otherwise inaccurate information, including pricing and product specifications. French Detours is not responsible for typographical errors or omissions and shall not be liable for any incidental or consequential damages caused directly or indirectly from anything on French Detours website. French Detours reserves the right to change prices or discontinue products at any time without prior notice while reserving the right to refuse or conduct a cancellation on its transaction activities due to price inconsistency from its suppliers.
French Detours website and mobile applications and online services may be used only for lawful purposes by individuals and companies. You are responsible for your own communications, including the upload, transmission and posting of information, and are responsible for the consequences of their posting on the website. French Detours specifically prohibits any use of the site, and requires all users to agree not to use the site for any of the following:
Posting any information which is incomplete, false, inaccurate or not your own,
Impersonating another person,
Constituting, engaging in or encouraging conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any city, state, national or international law or regulation or which fails to comply with accepted internet protocol,
Transmitting or transferring by any means information derived from the site to foreign countries or certain foreign nations in violation of US export control laws,
Attempting to interfere in any way with French Detours website or French Detours’ s networks or network security, or attempting to use the site’s services to gain unauthorized access to any computer system.
Violations of system or network security may result in civil or criminal liability. French Detours will investigate occurrences and may involve, and cooperate with law enforcement authorities in prosecuting the user or users who are involved in such violations. You are prohibited from violating or attempting to violate the security of the site, including, without limitation, the following:
Gaining access to data not intended for such user or logging into a server or account which user is not authorized to access,
Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization,
Attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the site, overloading, flooding, mail bombing or crashing, or
Sending unsolicited e-mail, including promotions and or advertising of products or services, forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting.
Information gathered for the purpose of creating, processing and completing your online order from French Detours web boutique is kept private. We never sell, rent or share your telephone number or your e-mail address with anyone. Unless instructed not to do so, French Detours may send you some information for your personal use, e.g. information on new products, newsletter, blogs.
Eligibility, Payment Terms, Orders
In order to use the service, you are required to register for a digital account on the site. You must be 18 or older to use the service. Terms of payment are within French Detours’ s sole discretion and unless otherwise agreed to in writing in advance by French Detours, full payment must be received by French Detours prior to French Detours ‘s acceptance of an order.
At this time, payment for products sold via the service may be made by valid credit card only (Visa, Mastercard, American Express, Discover). French Detours may invoice parts of your order separately. Orders are not binding upon French Detours until accepted by French Detours (meaning your credit card has been charged by French Detours and the products comprising your order have been transferred from French Detours to the common carrier that will deliver your order to you). Prices for products sold via the service will be valid for the period stated on the site. French Detour reserves the right to limit the order quantity on any product and/or refuse to ship product to any customer for any reason, or for no reason whatsoever, with or without prior notice.
Any communication or other information sent to French Detours via electronic mail or otherwise in connection with your use of the site, including but not limited to suggestions, ideas and comments, will be treated as non-confidential and all such information may be used by France Detours for any purpose without compensation. Disclosure shall constitute an assignment of all right
Shipping Charges, Taxes
Products sold via the service may only be shipped to customer addresses within the United States. Additional charges and restrictions may apply for orders shipped to addresses in Alaska or Hawaii. Separate charges for shipping and handling will be shown on the order summary portion of the service’s checkout page. Unless customer provides French Detours with a valid and correct tax exemption certificate in advance applicable to the product ship to location prior to French Detours’ s acceptance of the order, the customer is responsible for sales and all other taxes associated with the order. Minnesota state taxes for all shipments will be charged at the rate of 7.125 %. The separate charge for taxes will be shown on the order summary portion of the service’s checkout page. You agree that you will not obtain or direct shipment of product sold via the service for export.
Title, Risk of Loss
Title to, and risk of loss of, products comprising your order passes from French Detours to customer upon transfer by French Detours of such products to the common carrier you selected at checkout. Loss or damage that occurs during shipping by the common carrier selected by the customer is customer’s responsibility.
Warranty and Return Policy
Your total satisfaction keeps us in business. All the products offered by France Detours are carefully selected and we hope you will enjoy them as much as we do. If a product has a defect, please e-mail us and we will promptly replace the product or refund the merchandise, so that we can give you a Return Authorization Number. This limited warranty is contingent upon proper use of the products and does not cover products that have been damaged (scratches, bent metal, broken components,…), misused, modified or subject to unusual physical or electrical stress. All returns for any reason must be made within the first thirty days (30) days from time shipment and will be subject to a 25% restocking charge. Customer must include all original components, literature, packaging in the same sellable condition received to avoid any additional charges. All returned products must have a French Detours Return Authorization Number visible on the exterior of the package. Unauthorized returns, refused shipments, and authorized returns of non-defective merchandise after the above stated return period are subject to additional charges.
Perishable items are shipped separately. Usually, these fresh products are shipped directly from our vendors’ s own processing plants and cannot be combined for shipment or order a combination of perishable and non-perishable items, they are treated as two separate orders. We will usually process your order within 2 business days and shipped as soon as possible, unless you request a future arrival date. They are shipped in reusable Styrofoam boxes. Please, refer to the specific product page to check the shelf-life of perishable products. Shipping and handling charges for perishable goods are based on the weight of the merchandise that you order and the destination of the package.
No claim made by the customer shall be for an amount greater than the purchase price of the product or item in respect of which the claim was made, regardless of whether the claims pertains to damage incurred in shipping, failure to ship, or inherent defects. French Detours will in no way be liable for incidental or consequential charges. In all events, French Detours reserves the option of repair or replacement at its discretion.
Arbitration and Jurisdiction
This agreement is made in accordance with the laws of the State of Minnesota. You hereby agree that any claim or dispute between you and French Detours arising out of or relating in any way to the terms, your purchase of the products via the service, or use of the products you order must be resolved through final, binding arbitration. This arbitration obligation applies regardless of whether the claim or dispute involves warranty, tort, fraud, misrepresentation, product liability, negligence, violation of a statute or any other legal theory.
Waiver of right to bring claims in court and to have them heard by a judge or jury: You specifically acknowledge and agree that you expressly waive the right to bring a lawsuit in court base on any claims or disputes, and that you expressly waive the right to have such lawsuit resolved by a judge or jury, and as such you hereby agree to resolve any and all claims via binding arbitration.
Before commencing any arbitration proceeding under the terms, you must first present your claims or disputes to French Detours in writing and allowing the customer service of French Detours the opportunity to resolve the claims or disputes. If your claims or disputes are not resolved within sixty (60) days, you may commence arbitration proceedings in accordance with the terms.
Entire Agreement, Severability
These terms and conditions constitute the entire agreement with respect to your access and use of the French Detours site.If any provision of these terms and conditions is unlawful, void or unenforceable, then that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability. Notwithstanding the foregoing, under no circumstances do the parties agree to class-arbitration.
